Copyright Violation

If you have found unauthorized reproduction of your work on the internet and wish to stop the infringement of your rights please complete and submit the form below.

1.     On receipt of the completed form we will check to satisfy ourselves that your claim to the copyright is reasonable and that we can take your instruction to effect the removal of the work from the offending internet site(s). Please understand that we will not involve ourselves with frivolous or vengefully motivated claims.

2.     On removal of your work from the offending site(s) we will advise you whether it is commercially viable to sue the infringer for loss/damages.  We regard litigation commercially viable if our associate Lawyers will handle the matter on the basis that their fees come from the infringer with no contribution from the copyright owner. Please understand that our associate Lawyers will not involve themselves in frivolous or vengefully motivated litigation.  

3.     For this service we charge a flat fee of £100. The money is used to pay our staff £10. per hour time spent working on your account. All time spent is logged and if the job is done in less than 10 hours the unused portion of the cash is placed in a pool to cover instances when more that 10 hours are needed to get the job done. On the successful completion of the job you will be advised whether you are a 'cash pool' contributor or recipient. This is an extension of a service we have been pleased to provide for authors who's work we have published. If your work does not have an ISBN number

4.     We would expect your work to be removed from an offending site within 14 days from the day of our acceptance of your instructions.

5.     With regard to multiple infringements. Usually it takes around the same time to deal with multiple works on the same or multiple sites as it does to deal with one work on one site.  In certain instances of multiple works you may be asked to identify clearly each work and its  location. We can do this for you but we need to charge a fee for the service.

6.     If we fail to effect the removal of the work from the offending internet site or fail to have the majority of multiple works removed from the majority of multiple offending sites then the fee is refunded in full. To date we have been successful in causing to be removed 70+ instances of copyright violation (literary works) within 8 days of taking action. That is a 100% success rate.

7.     If you answer Yes to question 13. Get royalty payment. We will simply change our action from 'remove this material' to 'unless you pay the author (the figure mentioned at 14.) then you must remove the offending material'. We do not, within the remit of this agreement undertake to negotiate royalty payments on your behalf.  

8.     If the work is not registered with the US Copyright Office and does not have an ISBN number, you must answer yes at question 12. I agree that my submitting this form is my appointment of Babash Publishing as my duly authorized agent in respect of the title(s) outlined in this form for the period: From the date of submission of this form until I give notice by e-mail addressed to copyright@babash.com or until my dispute with the infringer(s) indicated in this form is settled or three months from the date of my submission of this form.
    
This provision gives us the legal power to act to stop the infringer on your behalf. We undertake here and now to confine our activities as agent to matters strictly related to the particular copyright issue mentioned in the form. And we undertake not to seek any commercial or financial advantage for ourselves, directly or indirectly as a consequence of our appointment as agents.
